TINUADE AKOMOLAFE-WILSON, JCA (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Kogi State holden at Okene, delivered by his Lordship Hon. Justice J.J. Majebi on the 25th April, 2016 wherein the learned trial judge convicted and sentenced the appellant to ten (10) years imprisonment for the offence of Armed Robbery contrary to Section 298(c) of the Penal Code.

The brief facts of the case are that on or about the 22nd days of September, 2014 at about 2 am, the police informant in this matter, Felicia Vincent (PW1) was sleeping with her children namely, Patience Vincent, and two others in her apartment located at A.T Sule Ahmed's compound, check point, Okene, Okene Local Government Area of Kogi State, when the accused person and one other person out of the four men (alleged robbers) who were allegedly masked and armed with guns (wore black clothes), forcefully entered her bed room and robbed her of the sum of ₦10,000.00 (Ten thousand naira) an…
