JAMILU YAMMAMA TUKUR, J.S.C. (DELIVERING THE LEADING JUDGEMENT): This is an appeal against the judgment of the Court of Appeal, Ibadan Judicial Division in Appeal No. CA/IB/384/2020, delivered on 12th April 2022, against the Appellant. 

The summary of the facts which culminated in this appeal is that the Respondents acting on the belief that they were the owners of the land in dispute instituted an action before the High Court of Justice, Ogun State, claiming the following: 

1. A declaration that the claimants are the persons entitled to the Statutory Right of Occupancy in respect of all that piece/parcel of land situate, lying and being at Ona-Oju Eegun, Ogunrun-Eletu Village via Mowe in Obafemi Owode Local Government Area of Ogun State measuring 4.373 Acres (17,696.103m2) described on Survey Plan No OG/313/K made by Surveyor S. J. Anthony and thereon boarded RED.
