JAMES SHEHU ABIRIYI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling delivered on 7th November, 2016 in the High Court of Taraba State sitting at Jalingo. The 1st Respondent is the plaintiff in the High Court. The Appellant is the 1st Defendant.
The 1st Respondent took out a writ of summons against the Appellant and 2nd and 3rd Respondents claiming for the following:
(a) A Declaration that the purported Selection of Kpanti Zing organised, conducted and supervised by the 3rd Defendant on the 5/11/15, at the College of Education, Zing conference hall is null, void of no effect whatsoever and contrary to the laid down rules and procedure.
(b) A Declaration that the purported selection and subsequent appointment of the 1st Defendant as the new Kpanti Zing, Zing Traditional Council is null, void and not in accordance with the Law and the Laid down rules and procedure.
