SANI V. STATE

VICTORIA TOOCHUKWU NWOYE, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Sokoto State, delivered on the 5th day of December 2024 in Charge No. SS/216C/2024, wherein the Appellant stood trial for culpable homicide punishable with death under Section 191 of the Penal Code Law of Sokoto State, 2019.

The case of the prosecution was that on 8th of October 2023 at Makuwana village, Sabon Bimi L.G.A., the Appellant and two others conspired and murdered one Jafar Sani. Two cutlasses (Exhibits P1 and P1A) and the Appellant's alleged confessional statements (Exhibits P2 and P2A) were tendered. Appellant denied the charge, asserting that his confessional statement was involuntarily obtained and inconsistent with the facts of the case. Trial Court, after hearing the case of the Prosecution and defence of the Appellant, convicted and sentenced the Appellant.
