SANUSI IBRAHIM V. FEDERAL REPUBLIC OF NIGERIA

JUMMAI HANNATU SANKEY, J.S.C. (Delivering the Lead Judgment): This appeal was filed by the Appellant herein (who was the 6th Defendant before the trial Court) against the judgment of the Court of Appeal, Yola Judicial Division, Coram Judex: Chidi N. Uwa, JCA, S. Abiriyi, JCA and Abdullahi M. Bayero, JCA, delivered on July 3, 2019 affirming the judgment of B. B. Aliyu, J. of the Federal High Court, Yola Division of May 9, 2015 wherein the Appellant was convicted as charged and sentenced to twenty years imprisonment each on two counts, sentences to run concurrently. 

The facts of the case as presented by the parties are that on March 21, 2012, operatives of the National Drug law Enforcement Agency (NDLEA), Adamawa State Command, went for an operation in Loko Village in Song Local Government of Adamawa State, to arrest the 1st and 2nd Defendants and their associates, after an intelligence and surveillance report revealed their illicit dealings in narcotic drugs.
