ADEBUKUNOLA ADEOTI IBIRONKE BANJOKO, J.C.A. (Delivering the Leading Judgment): This is an Appeal against the Judgment of the Federal High Court Maiduguri sitting in Maiduguri, delivered by Hon. Justice Jude K. Dagat on the 9th day of November, 2022 in Suit No: FHC/MG/CS/32/2022 as seen on Pages 100-119 of the Records of Appeal.

The facts that gave rise to this appeal were that the Appellants were members of the Borno State Executive Committee of the 1st Respondent, Peoples Democratic Party (PDP) and being dissatisfied with the performance and leadership style of the 2nd Respondent, who was the Chairman of the State Executive Committee, convened an extra-ordinary State Executive Committee Meeting on the 30th day of June 2022, wherein they deliberated and resolved to suspend the 2nd Respondent as State Chairman of the 1st Respondent. It was stated that out of the 42 State Executive Members, 38 voted for his suspension and subsequently, the meeting was adjourned.
