Judgement

ABBA-AJI JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the Federal High Court sitting at Abuja, presided over by S.J. Adah J, delivered on 20 October 2006.

The appellant who was the plaintiff at the trial court had sued the respondents herein claiming, vide its further and better amended statement of claim dated 4 February 2004, for the following reliefs:

(a) A declaration that the defendants are not entitled to seal or take over or attempt to seal or in any way whatsoever interfere with the management, or control, or the running of the plaintiff bank, contrary to the clear and specific provisions of the Banks and Other Financial Institutions Act, 1991 (as amended).

(b) A declaration that the defendants are not entitled to revoke or suspend the banking licence of the plaintiff or in any manner whatsoever prevent the plaintiff from its normal banking business.

(c) An order of this court setting aside the order of revocation of plaintiff’s banking licence…
