Judgement

PATS-ACHOLONU, JCA (Delivering the Lead Judgment): This is anappeal, against the ruling delivered by the learned trial court in the court below dismissing the main motion to have the suit dismissed. In the suit, the respondent, as plaintiff, states that he is the 5th Highest Ranking Nigerian in the 1st appellant company and had worked for more than 26 years and had variously held high positions, including that of Deputy General Manager.

He complained that the 1st respondent had formed the habit of recruiting through the backdoor without abiding by the laws and regulations relating to the expartriate quota and mentioned the names of several expatriates who came in through this allegedly irregular manner. Amongst the people mentioned are the 5th and 6th appellants. He averred that for example, sometime on 5th of May, 1997, the 1st appellant caused a letter purporting to cancel retrospectively and unilaterally the contract of all its staff and enclosed a transcript amounting to unilater…
