OBIETONBARA O. DANIEL-KALIO, J.C.A. (Delivering the Lead Ruling):This Ruling is in respect of an application for an injunction. The applicant Ibrahim Shehu Shema CON through his learned Counsel, on 7/9/16 filed a motion on notice in which he sought for an order of injunction restraining the 3rd to 11th Respondents from continuing with the proceedings of a Judicial Commission of Inquiry pending the hearing and final determination of an appeal filed against the decision of the Lower Court. The grounds upon which the application was made as shown in the motion paper are the following:-

1. The Appellant/applicant is dissatisfied with the judgment of the Lower Court and desirous of appealing against same.

2. The issue involved in the grounds of appeal involves facts of the case as well as application of law.

3. The record of proceedings of the Lower Court has been transmitted to this honourable Court and the appeal entered.
