PETER OLABISI IGE, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Federal Capital Territory High Court, Abuja delivered on 12th March, 2019 in Suit No. FCT/HC/CV/1981/2018 wherein judgment was given against the Appellants. 

The Respondent had approached the lower Court vide Undefended List Procedure on 4th June 2018, claiming jointly and severally against the Appellants as follows:-

”1. An order of this Honourable Court directing the Defendant to effect an immediate refund of the sum of N17,000,000 (Seventeen Million Naira) only and $26,000 US Dollars being the payment made by the Plaintiff for the purchase of a prototype of 4 Bedroom, Duplex with BQ, rooms ensuite house unit No. FB30 at Plot 4545, Mbora District, Abuja F.C.T. with Plot seize (sic) 500 Square meters from the Defendants. 

2. 15% interest on the judgment sum until it is liquidated. 

3. The sum of 2,000,000.00 (Two Million Naira) only being the cost of this suit."
