THOMAS JCA (Delivering the Lead Judgment): This is an appeal against the judgment of P.N.C Agumagu J dated 19th June, 2001 sitting at Port Harcourt Judicial Division of the High Court of Rivers State.

The brief facts of the case is that the plaintiff now to be simply referred to as respondent had filed her claim against the defendant now to be simply referred to as appellant as follows:-

“The plaintiff’s claim against the defendant is as follows:

1. A declaration that the compensation assessed as the sum of ₦15,516.00 (fifteen thousand five hundred and six naira) due and payable by the defendant to the plaintiff as a result of the industrial accident sustained by the plaintiff in 1995 while in the employment of the defendant was not adequate as it did not take into account other social, psychological and mental torture and injury associated with her disability and continuing medical care for a long period of time.
