Judgement

ONIYANGI JCA (Delivering the Lead Judgment): The appellant stood trial before the High Court of Ogun State sitting in the Ayetoro Judicial Division, Ilaro, for a five count charge of conspiracy to commit a felony to wit: armed robbery and armed robbery contrary to section 5(6) and punishable under section 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap. 398, Laws of the Federation of Nigeria, 1990 (as amended) by the tribunals (Certain Consequential Amendments) Act, 1999.

He pleaded not guilty to each of the count and the case went into full trial. Prosecution cal ed four witnesses comprising of the two complainants and the two Investigating Police Officers, and tendered as evidence the following exhibits: Confessional statement of the accused dated 4 June 2006 - exhibit A.

Medical report dated 3 August 2006 - exhibit

(3) Statement of appellant in English and the translated faction dated 21 June 2006 - exhibits C1 and C.
