TANI YUSUF HASSAN, J.C.A. (Delivering the Leading Judgment): The respondents as claimants in the High Court of Rivers State holding at Okrika instituted an action by way of Writ of Summons and Statement of Claim dated and filed on the 10th day of November, 2015 against the appellants as defendants therein. The statement of claim was amended and the Amended Statement of claim was dated 28th day of November, 2016. The Amended Statement of Claim was further amended. The further Amended Statement of Claim was dated and filed on the 12th of October, 2017 with leave of Court; wherein the claimants claim against the defendants jointly and severally as follows. 

(a) A declaration that the claimants are the persons exclusively entitled to the use of the ancestral name kilikome 

(b) A declaration that the 1st defendant is not entitled to use any of the names; Atuboyedia, Dikibo, Kalapoku and Kilikome as the name for any Chieftaincy House in any shape or form.
