BA’ABA, JCA(Delivering the Lead Judgment): This is an appeal against the judgment of the Delta State High Court, holden at Warri, delivered on 18/7/2000, in suit No. W/393/98. There is also a cross-appeal against the said judgment. The respondent/cross-appellant was the plaintiff in the court below where he claimed against the appellant/cross-respondent as per paragraph 4 of his Amended Statement of Claim as follows:- “42.
