BA’ABA, JCA(Delivering the Lead Judgment): This is an appeal against the judgment of the Delta State High Court, holden at Warri, delivered on 18/7/2000, in suit No. W/393/98. There is also a cross-appeal against the said judgment. The respondent/cross-appellant was the plaintiff in the court below where he claimed against the appellant/cross-respondent as per paragraph 4 of his Amended Statement of Claim as follows:- “42. WHEREOF the plaintiff claims against the defendant as follows:- A declaration that the summary dismissal of the plaintiff by the defendant as contained in the defendant’s letter of 24th April, 1998 is unlawful, illegal, unconstitutional, null and void and of no effect whatsoever. A DECLARATION that the summary dismissal of the plaintiff from the services of the defendant for concorted reasons having criminal traits and ingredients, without affording the plaintiff any hearing at all before a court of competent jurisdiction is illegal, null and void and of no effect…
