ABUBAKAR MU’AZU LAMIDO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of the Federal High Court, Kano Judicial Division delivered by Egwutu, J. on 18th June 2019. The Appellants are the plaintiffs whereas the Respondent is the Defendant. The plaintiffs/Appellants commenced this action by a writ of summons and claim the following reliefs in their amended statement of claim:

a. A DECLARATION that the Plaintiffs’ account with the Defendant Kano branch has been illegally over charged and wrongly debited.

b. AN ORDER of this Honourable Court setting aside all over charges either by way of interest, unauthorized dealing in the account and all other unauthorized, dealing in the account and all other unauthorized unlawful and illegal transaction by whatsoever name or described by the Defendant in respect of the 1st Plaintiff’s account as being illegal, unlawful, null and void.
