ORJI-ABADUA JCA (Delivering the Lead Judgment): On the 20 March 2006, the appellants instituted legal proceedings against the respondents at the Kano State High Court in suit No. K/107/06. The 1st appellant and the 1st respondent were formerly married, while the 2ndappellant is their son. The reliefs sought as per the endorsement on their statement of claim are thus:
“A declaration that the plaintiffs are the rightful owners of the landed property situate and lying at No. 2, Tamandu Close,
Nassarawa G.R.A., Kano covered by the Kano State certificate of occupancy No. LKN/RES/89/2396.
A declaration that the 2nd plaintiff is the holder/beneficiary and the person entitled to the unexpired term of grant of the certificate of occupancy No. LKN/RES/89/2396.
