MUNTAKA-COOMASSIE JCA (Delivering the Lead Judgment): The respondent, was the plaintiff in the court below - High Court of Justice, Ilorin, Kwara State of Nigeria, Coram Olabanji Orilonise, J and claimed, in his amended statement of claim against the defendantsnow appellants as follows:-

Exemplary damages of five million naira (N5m ) being damages for libel contained in a letter Ref. No.

REG/P/1639 dated 18th August, 1997 and another letter Ref. No. REG/P/1639 dated 22nd of November, 2000 published by the defenda nts to Federal Polytechnic Offa and Osun State Polytechnic, Iree respectively.

An order to withdraw the two publications from the Federal P olyt e chnic, Offa a nd Osun St at e Polytechnic, Iree respectively.
