FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Leading Judgment): This is an appeal by the Appellants who were the 1st and 2nd Defendants at the trial Court in Suit No: FHC/AWK/CS/139/2022: HON. ORAEZUENNEKA HELEN v. ODUKWE CYRIL OKWUDILI SUNDAY and ORS against the decision of the Federal High Court of Nigeria sitting in Awka as contained in the judgment delivered in the suit on 6th December, 2022 by Hon. Justice H. A. NGANJIWA. In the said judgment, Court dismissed the objections raised by the Appellants on the competence of the 1st Respondent's Originating Summons and on the merit, sustained the reliefs of the 1st Respondent and also granted in her favour reliefs not sought by the 1st Respondent.

Dissatisfied with the decision of the Federal High Court aforesaid, Appellants initiated this appeal by virtue of a Notice of Appeal filed on 13th December, 2022 complaining on seven (7) Grounds of Appeal. From the seven (7) Grounds of Appeal, Appellants have formulated four (4) issues for …
