Judgement

AGIM, J.S.C. (Delivering the Leading Judgment): The 3rd respondent herein scored the majority votes in the 3rd October 2018 primary elections of 2nd respondent to select or nominate the 2nd respondent’s candidate for the then forthcoming 16th February 2019 general election of member House of Representatives for Takai/ Sumaila Federal Constituency Kano State and therefore won the said primary election and became entitled to be the 2nd respondent’s candidate for the said election. Instead of submitting his names to the 1st respondent as its candidate for the said general election, the 2nd respondent, contrary to its constitution and electoral guidelines, submitted the name of one Abdulrahman Kawu Suleiman, who contested and lost the said primary election, to the 1st respondent as its candidate for the said general election. Aggrieved by the action of the 2nd respondent herein, the 3rd respondent on 10/1/2019 brought an action in the Federal High Court at Kano in suit No. FHC/KN/CS/04/20…
