CHIOMA EGONDU NWOSU-IHEME, J.C.A. (Delivering the Leading Judgment): The Appellant was the Defendant at the trial Court in a suit filed by the Respondent herein as claimant. Judgment was entered against the Appellant in favour of the Respondent by E. Ibok J, of the Calabar Division of the Cross River State High Court in suit No. HC/404/2010 delivered on the 18th of December, 2014.

The Respondent (as claimant) by writ of summons filed this suit on the 26/10/10 against the Appellant. In his statement of claim also filed on 26/10/10, he sought the following reliefs:
