THE REPUBLIC V. ABDUL-FATAW ISSAHAKU DELIMAN EX PARTE: ABDUL-RAFIU ISSAHAKU YARO

JUDGMENT

This is an appeal against a decision of the High Court (Commercial  Division) Tamale which dismissed an application for committal for  contempt brought by the applicant/appellant (hereinafter referred to as  the appellant) against the respondent/respondent (hereinafter referred to  as the respondent). The said application at the Tamale High Court alleged  that the respondent had disobeyed the orders of the District Court, Tamale  dated 14th June 2024, to account for rent received from tenants in H/No.  B385 Tishegu-Tamale, the property of the late Issahaku Deliman. 

The crux of the appellant’s case was that the respondent had collected rent  from the tenants in the subject house, for which he was ordered by the  District Court to account for all the monies received from the said tenants  within two months.
