This is a decision in respect of an application for the committal of the respondents for contempt of court.

THE ANTECEDENTS OF THE CASE:

The Plaintiff issued a writ of summons and statement of claim on 25th of October, 2011, praying for the following reliefs against the defendants;

a)     An account of all the proceeds from the renting of the 13 stores since 1998.

b)     Account of the stewardship of the estate to the beneficiaries.

c)     Distribution of the parts of the estate to the beneficiaries.

d)     Provision of the original copy of the probate.

e)     Cost of litigation.

On the 9th of June, 2016, Judgment was given for the Plaintiff for all the reliefs endorsed in the writ of summons. The Defendants, the two Respondents herein and a third, (Samuel) Kwasi Afram, dissatisfied with the decision of this Court, appealed for same to be set aside by the Court of Appeal and  succeeded.  There was a further appeal to the Supreme Court which overturned the decision …
