JUDGMENT

INTRODUCTORY COMMENT

The accused persons were first arraigned before this Court differently constituted on the 4th of July, 2013 per a charge sheet filed on the same day.

The hearing eventually commenced in October, 2013 before the instant judge.

This court ruled on the 7th of May, 2014, that there was a case to answer on the part of both accused persons.

Dissatisfied with the decision of this court directing them to answer to the charges, both accused persons appealed the decision. They also filed an application for stay of the proceedings in this court which was dismissed. The matter went on appeal to the Court of Appeal and finally to the Supreme Court.

Eventually, the matter of the submission of no case culminated in the decision of the Supreme Court in ASAMOAH AND ANOTHER v. REPUBLIC (CRIMINAL APPEAL NO. J3/4/2017) [2017] GHASC 13 (26 JULY 2017). (The decision is available on www. ghalii.org)
