JUDGMENT
This is an appeal against the judgment of the District Court, Prestea dated 19Â November, 2020. The Appellant, an Indian national was charged with one count of causing unlawful damage to property contrary to section 172 of the Criminal Offences Act, 1960 (Act 29) and one count of stealing contrary to section 124(1) of Act 29. Per the court record, Appellant pleaded guilty to both counts and the court convicted him on his own plea. The court subsequently invoked section 35 of the Immigration Act, 2000 (Act 573) and made an order to the Ghana Immigration Service recommending his deportation from the country.
Aggrieved by the decision of the court, Appellant has filed the instant appeal praying the court to set aside the conviction and the deportation order. The grounds of appeal as captured in the petition of appeal are as follows:
