Per the motion on notice for committal for contempt of Court filed on 29th May, 2018, the Applicant prays the Court for the attachment and imprisonment of the Respondents upon the grounds stated in the accompanying affidavit.
The gravamen of the case for contempt in the supporting affidavit to the instant application hinges on paragraphs 5 to 7. The Applicant says that despite the awareness of the grant of an Order of interlocutory injunction by this Court differently constituted on 21st November, 2013, that specifically prohibited or barred the Respondents, ‘their agents, assigns, successors and all those who claim their titles through them from by any mode i.e. placing containers, parking cars, placing blocks on the land, building etc. are restrained from encroaching on part of the land fronting the house of the 1st and 2nd Defendants being part of their land till final determination of the suit’, the Respondents have continued to grant parts of the frontage of…
