This is a Ruling on an application for Judicial Review in the nature of Certiorari brought for and on behalf of the Applicant, Joseph Allotey.

The facts of the case giving rise to this application is that the Interested Party took an action against the Applicant herein in the District Court Amasaman seeking the following reliefs;

a) An Order restraining the Defendant herein from claiming ownership of title to all that piece of land situate lying and being at Nasakina containing an approximate area of 0.22 acres or 0.09 hectares more or less and bounded on the North East by a proposed road measuring 80 ft. more or less, on the South West by lessor’s land measuring 100 ft. more or less, on the North West by lessor’s land measuring 180 ft. more or less which said land Plaintiff has been adjudged owner.

b) Cash the sum of GH¢25,000 being the cosy Plaintiff incurred on the cost of the fence wall destroyed by Defendant.
