Judgement

RULING 

The background facts of this judicial review application are fairly simple and incontrovertible. On the 27 day of January, 2021 the Interested Parties herein instituted action against the Applicant herein before the Judicial Committee of the Sekondi Traditional Council (Respondent herein) seeking the following reliefs: 

1. A declaration that the Defendant and his faction belong to the Royal Kokodo Abantwewa Ebiradze Family of Ngeresia which is under the Essikado Paramountcy and are not members of the Royal Kokodo Ebiradze Family of Fijai.

2. A declaration that the Defendant and his faction have no capacity to challenge the 1st Plaintiff’s installation as the Gazetted Chief of Fijai or to determine who has a right to mount the stool of Fijai.

3. A declaration that the Defendant’s attempts to challenge the installation and gazetted chief of Fijai, that is, the 1st Plaintiff is contrary to the custom and traditional practice of the Fijai Stool since the Fijai Stool belongs to the Ro…
