Judgement

1 Background

The first time the parties met in court on the suit after the plaintiff commenced the action on 4 November 2020 was on 20 November 2020. It was for directives for trial. On that day the parties through their lawyers sought and obtained leave of the court to settle the suit out of court. The parties have indeed settled out of court the main issue – payment of the principal amount owed and due to the plaintiff. They are however unable to agree to the issue of payment of interest and costs, and that after a couple of adjournments on the matter, and the court realizing that there appears to be no consensus in sight agreed with the court to submit their written submissions the issue of award of interests and costs the only outstanding issue for determination. The decision of the court is thus mainly and simply on the issue of interest and costs.
