<p>CLARA BATA OGUNBIYI, J.C.A (Delivering the leading : ): The appellant in this appeal was the Defendant of the court below while the Respondent was the plaintiff wherein he took out a writ of summons against the former on the general cause list and claiming the following reliefs per paragraph 21 of the statement of claim of Pages 7 and 8 of the record of appeal.</p><p> "21. WHEREFORE, the plaintiff claiming as follows against the defendant:</p><p> 1) A declaration that the dismissal of the plaintiff contained in a letter dated 19/6/1998 from the services of the defendant is wrongful, and unlawful in that it is against the principles of natural justice, ultra vires and of no effect. </p><p> 2) A declaration that the plaintiff is still in the services of the defendant and that he is entitled to his full remunerations, allowances and other benefits from December 1997.</p><p> 3) An order that the plaintiff who is an employee of the defendant be re-instated and paid all his salaries and allowances from December …</p>
