Judgement

ROWLAND, JCA: (Delivering the Lead Judgment): This is an appeal against the judgment of Elaiho, J., sitting at the High Court of Justice Benin, Edo State, delivered on 7/2/1996, wherein the sum of N15,000.00 (fifteen thousand naira) was awarded as general damages against the defendant/ appellant for the economic injury allegedlysuffered by the plaintiff/respondentarising from the former’s act of dishonouring his cheque No. 364196/992410 for N4,500 in favour of one Anthonia Ehiosu which was returned unpaid by the defendant/appellant. Pleadings were ordered, filed and exchanged. The case then proceeded to trial. After reviewing the evidence adduced by both parties, the learned trial Judge, in a reserved judgment, awarded N15,000.00 (fifteen thousand naira) as general damages against the defendant in favour of the plaintiff.
