Judgement

ABDULLAHI JCA (Delivering the Lead Ruling): On 14 December 2007, the Governorship and Legislative Houses Election Tribunal in the petition No. ABS/NAHR/EPT/33/07, sitting at Umuahia delivered its judgment setting aside the election and return of the appellant/applicant, hence his appeal to this court in appeal No. CA/PH/EPT/128/2008. The appellant/applicant approached this court and filed a notice of appeal which carries 7 grounds.

The appellant/applicant in a motion dated 13 November 2008 and filed on 14 December 2008, filed the present application seeking for the following orders:

“1. An order extending the time within which the appellant/ applicant can appeal against the ruling of the lower tribunal in this petition dated 7August 2007.

2. An order granting the appellant/applicant leave to appeal against the said ruling of the lower tribunal dated 7 August 2007 dismissing the objection to the jurisdiction of the lower tribunal to entertain this petition for being incompetent.
