ABUBAKAR JEGA ABDUL-KADIR, J.C.A. (Delivering the Lead Ruling): This is a consolidated post-judgment proceeding arising from the judgment of the Court of Appeal, Port Harcourt Division delivered on the 27th day of January 2009 in CA/PH/EPT/230/08; Sunday Ugwa and Anor v. Hon. Oji Lekwauwa and Ors. On the 27th day of January, 2009, the Court of Appeal, Port Harcourt Division delivered judgment in favour of the appellants in an appeal that arose from Abia State Legislative Houses Election Tribunal sitting at Umuahia. The Court of Appeal nullified the return of the 1st respondent by the 2nd respondent which was upheld by the Abia State Legislative Houses Election Tribunal. The 1st appellant was declared as elected as having scored majority of lawful votes at the State House of Assembly election into the Abia State House of Assembly conducted on the 14th day of April, 2007, by the 2nd Respondent INEC.

The parties were availed copies of the judgment on the said 27th January, 2009.
