NZEAKO, JCA (Delivering the Lead Judgment): The appellants in this appeal were the defendants in the action filed at the Federal High Court of Justice, Maiduguri, Borno State of Nigeria by the respondent herein, who was the plaintiff.

The plaintiff had claimed from the defendants the following reliefs:-

“A declaration of this Honourable Court that the purported termination of plaintiff’s employment with the University of Maiduguri Teaching Hospital, contained in a letter reference number UMTH/CON/27/1 and dated 6th May 1997 addressed to the plaintiff by one Wulfu G. Multafu for the Chief Medical Director of the University of Maiduguri Teaching Hospital, is null and void or ineffectual or unlawful by reason of gross irregularity, lack of reasonable cause, denial of natural justice and non-compliance with the enabling statutes establishing the defendants, and a breach of section (sic) of the constitution of the Federal Republic of Nigeria 1979 as duly amended.
