Judgement

YAKUBU JCA (Delivering the Lead Ruling): The High Court of Justice, Yola,Adamawa State, coram. B. P. Lawi, J., in the suit No.ADSY/ 132m/99, had dismissed the claim of the plaintiff, but entered judgment for the defendant in his counterclaim against the plaintiff. The said judgment was delivered on 30 September 2010. The records of that court on 30 September 2010 indicates that the plaintiff and her counsel were absent from court. However, the defendant and his counsel were present. Furthermore, the said records of the court, indicates that counsel to the plaintiff had been served with the hearing notice for 30 September 2010. In this application, the plaintiff/applicant pursuant to Order 7, rule 10 (1)(2) of the rules of this court, prays for:

“(1) An order extending the time within which the applicant may appeal against the judgment of the High Court of Justice, Yola , in suit No. ADSY/132M/99, between Union Bank of Nigeria Plc. v. Rev. Michael Jamthi.
