NSOFOR, JCA (Delivering the Lead Judgment): This appeal deals with the applicability of the Constitution (Suspension and Modification) Decree No .107 of 1993; whether it be “in futuro” or, retrospectively and how it affects the case of the respondent, qua plaintiff. It is an interlocutory appeal from the decision by the Kwara State High Court (S. Kawu, J.) on the 24th April, 1998 in an on going Suit No.KWS/37/91. The action arose ex contractu .

The plaintiff, herein the respondent, was an employee of, the University of Ilorin, the appellant herein. The plaintiff was employed by a letter Ref.No.UI/SSE/PF/866 dated the 9th of April, 1980 as a Deputy Bursar with effect from the 20th of May, 1980 and later was appointed a Bursar with effect from the 26th of October, 1983 by a letter Ref.No.UI/SSE/PF/ 866/67 of the 17th of November, 1983.
