UNIVERSITY OF ILORIN V. MR. A. I. ADENIRAN

HELEN MORONKEJI OGUNWUMIJU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of Hon. Justice S. D. Kawu of the Kwara State High Court sitting at Ilorin delivered on the 30th day of July 2004.

The Respondent was the Bursar of the University and thus a principal officer of the institution. The Respondent's appointment was terminated by the Appellant on the 28th day of February 1985. The Respondent did not protest at the time. He accepted six months salary in lieu of notice. He also accepted other entitlements such as leave grants and leave bonuses paid to him on his termination by the Appellant. He thereafter took up appointment as an accountant with Messrs Oyamoye and Co. a firm of Chartered Accounts.

On the 26/2/1991, six years less two days after the Respondent's appointment was terminated, the Respondent filed an action before the High Court of Kwara State sitting at Ilorin. The Respondent asked for the following reliefs as contained in paragraph 30 …
