AGUBE JCA (Delivering the Lead Ruling): On the 13th day of March, 2007 the appellant/applicant by an application dated the 7th day of March, 2007 and filed same day sought from this court the following orders:- “(1) Leave and order of this honourable court to allow the appellant/applicant to amend its brief of argument dated 22/11/2006 as per the schedule of amendment herewith attached and marked exhibit A.

An order amending the appellant’s/applicant’s brief of argument.

An order deeming the amended brief of argument already filed as properly filed and served.And for such further order or other orders as this honourable court may deem fit to make in the circumstances.”

The grounds upon which the application is predicated are hereunder stated as follows:- “1. The counsel for the appellant recently discovered some errors in issues 2 and 3 of the issues for determination in the brief of argument.
