IKONGBEH JCA (Delivering the Lead Judgment): The respondent herein was a medical student in the 1st appellant university and, prior to 19/ 04/02, went about his normal business as such student. On that date, however, he received a letter, dated 25/03/02 (placed before the trial court as exhibit TA7) from the secretary to the university’s students’ disciplinarycommittee (committee or S.D.C. for short), writing on behalf of the 3rd appellant, conveying to him the decision of the 2nd appellant expelling him from the university for allegedly spearheading a riot in the university. Not happy with this turn of events, the respondent took the matter to court.
Pursuant to leave granted him ex parte by the Federal High Court, sitting at Ilorin, to enforce his fundamental rights, he filed a motion on notice, wherein he sought the reliefs contained in the statement accompanying the motion.
