Judgement

ADAMU JAURO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of the Federal High Court, Bauchi Judicial Division presided over by Hon. Justice M.G. Umar delivered on 10th day of July, 2015 in Suit No. FHC/BAU/CS/22/2014.

The appellant before the trial Court brought this action under Enforcement of Fundamental Right Procedure wherein he sought the order of the Court for the following:

"1. AN ORDER enforcing the Applicant's Fundamental Human Rights.

2. AN ORDER declaring the action of the Respondent engaging its agents to arrest, detain and or torture the Applicant in connection with a business transaction between: GUROJEMINING COMPANY and SHENGJIA INTERNATIONAL (HK) LTD. that has already been amicably settled by the parties without instruction from any complainant as illegal, unlawful and unconstitutional.

3. That the connivance of the Respondent with unknown persons to arrest and detain the Applicant in the manner aforesaid is illegal, unlawful and a gross…
