HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A.(Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Plateau State delivered in Suit No PLD/J/160/2011 by Honorable Justice R. K. C. Adamu on the 22nd of May, 2014. The Respondent was the plaintiff before the lower Court and his claims against the Appellant were for:

i. An order setting aside the purported Sale Agreements dated 15th day of February, 2011 entered into between the parties in respect of the Plaintiffs one storey house consisting four units of three bedroom situate at No 12 Rafin Pa Close, Jos, and the Defendant's house consisting of eleven rooms situate at JG81 Angwan Mailambu, Apata Street, Jos.

ii. An order directing the Defendant to vacate the Plaintiffs house situate at No 12 Rafin Pa Close, Jos forthwith.

iii. An order of perpetual injunction restraining the Defendant by himself, his privies, assigns, representatives or anyone claiming through him from laying claim over the property at No 12 R…
