MUHAMMED LAWAL SHUAIBU, J.C.A. (Delivering the Leading Judgment): This appeal emanated from the judgment of the Sharia Court of Appeal Sokoto, Sokoto State delivered on 30/6/2010. The respondent and Abdullahhi Ruwa were claimants before the trial lower Sharia Court Dange jointly seeking an order against the appellant for the repossession of 7 farmlands. The said claim is at pages 1- 2 of the record of this appeal and it read as follows:

We Abdullahi Ruwa and Usman Ruwa are suing Sahabi Usman Hausare in order to repossess our farmlands which are seven (7) in number and in his possession. I, Abdullahi Ruwa permitted for the plots of farmland to be sold on behalf of my brothers. It has been about ten (10) years that he has been farming on the plots of farmland. Later, he requested that I sell the farms to him and I agree and we went into transaction for the sale but without the knowledge of my siblings who are co-inheritors.
