ABIRU JCA (Delivering the Lead Judgment): This is an appeal against the ruling of the High Court of Kano State in suit No. K/128/ 2008 delivered by Honorable Justice Nura S. Umar on 7 July 2008. By a writ of summons dated 7 April 2008, the appellant, as plaintiff , commenced an action against the respondent, as defendant, claiming for:
