ABBA BELLO MOHAMMED, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of the Federal Capital Territory, Abuja (the trial Court), delivered by Hon. Justice J.O.E. Adeyemi Ajayi on the 7th day of June, 2023. Dissatisfied with the said judgment, the Appellant filed a Notice of Appeal on the 20th day of June, 2023.

The facts leading to this appeal, as discernible from the Record of Appeal, are that the Respondents, as Claimant, instituted an action against the Appellant before the High Court of the Federal Capital Territory in Suit No. FCT/HC/CV/2623/2022, arising from a garnishee proceeding in which the Appellant was the judgment creditor and the 1st Respondent was the garnishee.
