Judgement

MUHAMMAD IBRAHIM SIRAJO, J.C.A. (Delivering the Lead Judgment): The Appellant was arraigned before the Federal High Court of Nigeria, in the Port Harcourt Judicial Division (hereinafter referred to as the lower Court) on a 9 (nine) count charge No: FHC/PH/230C/2012 for the offences of conspiracy to commit felony: Obtaining money by false pretence, obtaining money under false pretence contrary to Sections 8 (A), 1(1)(b) of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006. The particulars of the offence were given as follows: 

COUNT 1

That you, Abraham Walson, Marcus Udo Ifon (at large), Glory Eneyo Etifit (at large) sometime between November 2010 and May, 2011 at Port Harcourt, within the Port Harcourt Judicial Division, conspired amongst yourselves to commit felony to wit: Obtaining Money by False Pretence contrary to Section 8 (A) and punishable under Section 1(3) of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006.
