ONYEKACHI AJA OTISI, J.C.A. (Delivering the Leading Judgment): This appeal is against the decisions of the High Court of Nasarawa State sitting at Karu in Suit No NSD/MG59/13 Coram R.G. Soji, J., delivered on June 25, 2013 and on November 22, 2013.

The facts leading to this appeal as can be gleaned from the Record of Appeal and the respective Briefs of argument of the Appellants and the 1st-6th Respondents, are as follows: The Nasarawa State House of Assembly sometime in March, 2013 passed a law which is contained in Nasarawa State Legal Notice No. 2 of 2013 titled Nasarawa State (Creation of Additional Chiefdoms) Law 2003 upon which Gurku Chiefdom was created on the 19/3/2013. The Appellant was appointed Chief of Gurku Chiefdom by the 7th Respondent. The 1st-6th Respondents as plaintiffs in the lower Court by Originating Summons commenced this action against the 7th-9th Respondents as defendants in respect of the creation of Gurku Chiefdom by the Nasarawa State Government.
