HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A.(Delivering the Leading Judgment): This appeal is against the decision contained in the Ruling of the High Court of Borno State in Suit No BOHC/MG/CV/02/2013 delivered by Honorable Justice C. A. Hamza on the 5th of August, 2013.
The facts of this case as can be garnered from the processes in the Records of appeal are that the first Respondent commenced an action in Suit No M/76 /2003 against the Appellant and the second to the fifth Respondents, as first to the fifth defendants respectively, challenging the discriminatory sale of her house by the second to the fifth Respondents to the first Respondent. The matter was assigned to Honorable Justice John Jilantikiri of the Borno State High Court for hearing.
