Judgement

BA'ABA JCA (Delivering the Lead Judgment): This is an appeal against the judgment of Hon. Justice M. U. Alkali, of the Kano State High Court holden at Kano Judicial Division delivered on 23rd of June, 2003 wherein the respondent as plaintiff was awarded the sum of N3,000,000.00 (three million naira) as damages for the grievous bodily injuries sustained by the respondent against the appellants. By a writ of summons dated 14/6/95, the respondent herein as plaintiff instituted an action in the High Court of Justice Kano, Kano State against the appellants herein as defendants. The respondent as the plaintiff as per paragraph 31 of his statement of claim, claimed as follows:- “31. WHEREOF, the plaintiff claims jointly and severally against the defendants the sum of N3 million as damages for the grievous bodily injuries sustained by the plaintiff by reason of the negligent management of a delivery van belonging to the 2nd defendant by the 1st defendant while acting in the normal cause of …
