TINUADE AKOMOLAFE-WILSON, JCA (Delivering the Leading Judgment):

INTRODUCTION

This is an appeal against the Judgment of the Kogi State High Court, delivered by the learned Judge, honourable Justice M.M. Gwatana on the 8th of April, 2016. The Appellant was the 1st accused person at the Kogi State High Court and was charged along with a second accused person for the offences of both criminal conspiracy and armed robbery punishable under Sections 97 (1) and 298 (c) of the Penal Code.

FACTS OF THE CASE

The learned trial Judge at the conclusion of the trial convicted and gave a mitigated sentence of 5 years imprisonment for the offence of armed robbery and 3 years imprisonment for the offence of criminal conspiracy to both the appellant and the 2nd accused person respectively. The Appellant dissatisfied with the judgment appealed to this honourable Court on eight (8) grounds of appeal as contained in the notice of appeal on pages 164 -174 of the Record of Appeal.
