Judgement

KUDIRAT M. O. KEKERE-EKUN, JCA (DELIVERING THE LEADING JUDGMENT): This is an appeal against the judgment of the Federal High Court, Akure, Ondo State delivered on 21st July, 2010.

The appellant herein was employed as Tax Assistant III by the respondent on 12th February, 1998. Her appointment was confirmed after two years. She got married in February 2000 and gave birth to a baby in August 2005. She was transferred from the respondent's Akure branch to its Ibadan branch in February 2006.

After resuming work at Ibadan, she proceeded on her annual leave. After the expiration of her leave she overstayed by two months. The respondent issued her with two queries, which she responded to upon her resumption to duty. She also accompanied the replies with a letter of complaint against her transfer having regard to her marital status and recent child birth.
