Judgement

TABAI, JCA (Delivering the Lead Judgment): At the Failed Banks (Recovery of Debts) and Financial Malpractices in Banks Tribunal, Lagos

Zone IV, the appellant, who was the 3rd accused person therein, was tried along with two others on a four - count charge. The 2nd accused person was tried in absentia. The first accused person was charged alone in the first count. All the three accused persons were charged in the 2nd count for conspiracy while the 2nd accused person (then at large) and the appellant were charged in both the 3rd count and the alternative 4th count. At the end of the trial, the Tribunal presided over by Hon. Justice M. I. Edokpai convicted the appellant on the 3rd count and he was sentenced to the maximum punishment of 5 years imprisonment. The said 3rd count under which he was convicted reads:-

“That you Malam Nasir Abdullahi (now at large) and Bobai

Yohanna being the Bank Manager and Accountant respectively of Intercity Bank Ltd, Kaduna Branch between 14/2/95 and 31/3/9…
